Photography Terms and Conditions

Securing your booking

Bookings are accepted on a first come, first served basis. All booking must be secured with a non-refundable reservation/ booking fee , (the amount is by agreement between PKay Bridal and The client. Usually a 30% (for UK wedding) 50% plus Travel & accomadation expense (for destination wedding) non-refundable reservation fee is required to book our photographer. Date of booking by agreement via message, emails and conversations. For last minute bookings where the event date is less than 6 weeks away, the non-refundable reservation fee is 100% (please note that Quote and Enquiry is not booking confirmation, you are not booked in until the deposit is paid).

For photoshoot and lifestyle photo session, the total of the session fee is require to be paid up front (and payment clear) in order to secure your appointment and reservation.

Payment

We only accept cash or bank transfers. All deposits and payments are non-refundable but it is transferable. You are entitled to transfer/move your appointment once free of charge, if you decide to cancel your new appointment your deposit will be lost. If you would like to move your appointment again for a second time this will incur an extra £100 charge for date reservation.

All balances must be cleared and fully paid 6 weeks prior to your wedding/ Photoshoot date.

Coverage

We offer our services within the UK and Internationally. Wedding day Photography / Photoshoot coverage depending on the package that is purchased, which can also be agreed upon the client's request. Please note, our packages are provided on a basis of continuous consecutive hours, they cannot be divided up. Due to the commitment to weddings at the weekends, consultation, trial, engagement/pre-wedding portrait shoots are arranged Monday to Friday. The location of the engagement/pre-wedding portrait shoot is within 20 miles of Bishops Stortford. Otherwise, travel charges may apply. For Family photo session the fee/ package covers up to 5 Family members, every additional family member is minimum charge of £50 ahead.

Attendance

In the unlikely event that the PKay Bridal team is unable to complete the coverage due to unforeseen circumstances, PKay Bridal reserves the right to appoint another Hair stylist, Makeup Artist or photographer to attend on his/her behalf to undertake the services. If we cannot find the replacement team your money will be fully refund - excluded monies paid for works which have already been carried out (e.g. engagement photo session etc).

Travel Expenses

There is a travel fee of £0.50 per mile (round trip) for us to travel to the wedding venue on your wedding day. Congestion and parking charges may apply depending on the location. Additional extra charges will apply for long distance locations over 2 hours drive away from CM23 4EF (roughly 150++ miles round trip). If abroad the client is liable to provide our team with accommodation, flight, transportation etc. Price Exclude Entrance Fee to your chosen location, Clients accommodation, prop, Transportation, clothes & accessories, lunch & personal expense, print. For oversea or further afield may require further discussion as we may request for travel, flight and accommodation expense for the night before the wedding and possibly the night of the wedding.

Cancellations

You can cancel your wedding photography booking at any point, but your reservation fee, payment and your deposits will not be refunded but are transferable to the new wedding date. You are entitled to transfer/move your appointment once free of charge. You must consult and discuss with PKay Bridal before making rearrangement of your new date. If PKay bridal is unable to fulfil your new wedding date, we will sent an associate photographer as our replacement. If you refuse our associate photographer or if your decide to cancel your new appointment/ wedding date, PKay Bridal will be under no obligation to refund any money that has been paid up to the point of cancellation however the client will not be liable for any further payments. If you would like to move your appointment again for a second time this will incur an extra £300 charge for date reservation.

For round trips of over 80 miles, if you cancel or postpone your wedding and If PKay Bridal has already booked flights & accommodations in order to fulfil your Wedding day booking, the client is responsible to cover the cost of PKay Bridal’s flight & accommodation in full.

If the Engagement photo session has already taken place as part of the wedding photography package and the clients decide to cancel their wedding photography service due to any circumstances - PKay Bridal is entitled to keep all reservation fee and deposits for the Engagement photo session, date reservation, consultation, welcome pack and admin fee.

If your wedding/ Event was cancelled due to Government Force Majeure (e.g. pandemic, lock down, border closing), you are entitled to change or reschedule your date, but if you decide to change the venue, travel costs will apply depending on the distance to your new location (0.50p per mile round trip).

If the new date happens to fall on the same date as another client wedding/event PKay Bridal will arrange for a replacement photographer to take care of your parties. If you would like to have an engagement shoot with our replacement team, we will be responsible to schedule and organise an engagement shoot for you, but you will be responsible to cover the engagement shoot cost up front in full with PKay Bridal.

If the client refuses the PKay Bridal replacement team and decides to cancel our services, your reservation fee/ deposits will not be refunded.

If you have already selected your new wedding date, but then decide to cancel, your deposit will be lost.

In the circumstance where your wedding date is changed due to Government Force Majeure and PKay Bridal is unable to supply you with a replacement team. PKay Bridal agrees to partially refund your non-refundable deposit/booking fee that the client has paid up until the point of cancellation, but PKay Bridal is entitled to charge you the cancellation fee minimum of £350 for the wedding date reservation, consultations, and admin.

For any other reason of cancellation with less than 3 months notice 50% of the overall cost of wedding day services will still be due. PKay Bridal will be under no obligation to refund any money that has been paid up until the point of cancellation. For cancellation 4 weeks or less prior to the wedding day, a charge of 75% of total overall cost will be incurred...this is to cover lost time and missed opportunities, missed wedding date reservations, consultations, and admin.

If your engagement photoshoot is included in your full day wedding package and If you decide to cancel your wedding day photography service, the client is liable to cover the cost of the engagement photoshoot that has already been carried out - at PKay Bridal’s current rate plus the cancellation fee minimum of £300 for Wedding date reservation, consultations, admin. Beyond this the client will not be liable for any further payments.

For Photoshoot & Lifestyle Session any cancellation less than 72hr notice your payment will be lost. For cancellation with 1 week notice, PKay Bridal agrees to partially refund the 50% the non-refundable booking fee.

Photography

By confirming your booking with us, you agree that PKay Bridal may use any photography for publicity purposes which includes, but not limited to, our website and social media pages. This includes photographs taken by PKay Bridal and photographs taken by your professional photographer.

This Release gives the clients the right to reproduce and print high- resolution images for personal use. PKay Bridal agrees to allow photos taken at the Photo session/ Wedding to be used by Our clients. The client can freely use the images from these sessions for their personal use, and social media, as they see fit with (PKay Bridal photography credited).

This license does not include use that results in financial gain, including but not limited to: stock photography, print sale profits or resale of any nature. You may not under any circumstances alter, edit or change images - which includes, but is not limited to, photo editing apps and filters such as instagram.

Copyright of images will remain with the photographer/ Videographer under UK Photography law. The photographer (Phavinee Klongjing) reserves all the right to choose which photographs will display on PKay Bridal website and social media.

The client agrees to grant permission to PKay Bridal photography to use photographs taken of the client for use on social media, website and/or portfolios. the client hereby waives any right to inspect or approve the finished photographs or printed or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to the client or unknown, and the client waives any right to royalties or other compensation arising from or related to the use of the photograph. The photographer (PKay Bridal, Phavinee Klongjing) reserves all the rights to choose which photographs will display on PKay Bridal website and social media. This includes photographs taken by PKay Bridal and photographs taken by your professional photographer. All photographs will be supplied Online in digital form unless agreed otherwise.

**If the clients do not want their images to be displayed on PKay Bridal website, social media etc, they can purchase the full rights to their images from the photographer at an agreed price, but please mention this before you sign your contract. **

Please be advised that each photographer possesses their own distinct working style and approach, which is shaped by their personal experiences. Our responsibility lies in providing documentary-style services that capture the natural unfolding of your wedding day. While we strive to accommodate your specific shot requests and preferences, it is crucial to acknowledge that we cannot guarantee the fulfillment of every requested shot. In the event that a particular shot is not achieved, missed, or not taken, or if your family does not appear smiling or happy, we cannot be held accountable for any resulting dissatisfaction or adverse outcomes. Our prices are transparently presented and communicated to you prior to your commitment. By engaging our services, you acknowledge and agree to the stated prices. We do not offer refunds for services that have already been provided, regardless of any perceived dissatisfaction with the outcome.

Creative Licence. The client acknowledge and agreeing to grant the photographer, the creative freedom to capture an artistic representation of their day as the photographers choose, understanding that no two events will look the same and that PKay Bridal photographic style is constantly evolving. The Photographers style is largely reportage based. Please be advised that each photographer possesses their own distinct working style and approach, which is shaped by their personal experiences. Artistic and creativity licence is at the discretion of the photographer. Therefore we do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. Please also note that the number of photographs is also impacted by weather conditions and the willingness of subjects. The Photographers shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers judgement regarding the location, poses and number of photographs taken shall be deemed correct. Photographs taken during the course of a booking will be at the discretion of The Photographers although best endeavours will be made to comply with The Couples requirements. The Photographers shall endeavour to photograph all subject matter as requested by The Couple during the booking, but no responsibility will be taken by The Photographers should the subject matter not be available or willing at the time of the booking, or due to other factors such as available time and/or location of the subject matter or The Photographer(s). The Photographers movements are sometimes restricted due to, for example but not necessarily limited to, infrastructure, highways, weather, private property, obstacles (fixed and mobile), security, local law enforcement, emergency services and instructions from The Couple. The area from which The Photographers are able to cover the booking may not be The Photographers choice and The Photographers cannot accept responsibility for any obstructed view should this be the case. Our responsibility lies in providing documentary-style services that capture the natural unfolding of your wedding day. While we strive to accommodate your specific shot requests and preferences, it is crucial to acknowledge that we cannot guarantee the fulfilment of every requested shot. In the event that a particular shot is not achieved, missed, or not taken, or if your family does not appear smiling or happy, we cannot be held accountable for any resulting dissatisfaction or adverse outcomes. The Photographers shall endeavour to capture all the moments throughout the day as they occur, however, because of the dynamic nature of events, some moments might not be recorded. Our prices are transparently presented and communicated to you prior to your commitment. By engaging our services, you acknowledge and agree to the stated prices. We do not offer refunds for services that have already been provided, regardless of any perceived dissatisfaction with the outcome.

All images provided by PKay Bridal come with Standard Editing, which includes Bride and groom light skin retouch and some exist sign removal, as well as color grading. We hold great respect for our clients' natural beauty, recognizing that it comes in all shapes and sizes. As a matter of principle, we refrain from altering body shape, size, making adjustments to double chins, engaging in background replacement, or performing object or people removal. We firmly believe that these elements are an integral part of your unique story and should be preserved as they were captured in the moment.

As a professional photographer, our goal is to faithfully document and capture the essence of your special day and moments as they unfold naturally. Should you desire services such as body slimming, object or people removal, or any other extensive retouching, we are happy to offer recommendations for skilled professional retouchers. However, it is essential to note that in such cases, you will be solely responsible for contacting them directly and covering any associated costs.

It is important to acknowledge that PKay Bridal cannot guarantee the specific results or outcomes that may arise from third-party retouching services. We have no prior experience or association with these retouchers, and therefore, we cannot be held liable for any unsatisfactory results or dissatisfaction arising from such services.

When will my photos be ready to download?

Post process can take some time and how fast we can turn over the finished result depends on our current schedule. For full-day wedding package the first 15 preview images will be ready within 72 hrs on our social media page for you to share with your friends and families, so keep an eye out for our Instagram or Facebook feed.

All of your wedding photos will be ready between 10 -12 weeks

Photos from a short coverage Photoshoot session will be ready between 2 - 6 weeks

Within 72 hours after your Lifestyle/ Photoshoot you will receive a link to your gallery contains a set of unedited, low quality images with watermark on them. You will not be able to download this. You can choose certain amount of images (depends on package purchase) of your choice to be edit. Once you made your selection, I will spend sometime editing them, you will receive your final edit images around 2 - 6 weeks after that. It will be watermark free and you will be able to download high resolution images straight from there.

Download you images

The link to your online gallery will be sent to the email address that you submitted in your booking form. You will be able to download your photos directly from your online gallery. Within your gallery you will find the download option on the top right of your gallery. You will receive download notification via email when the files are ready for you to download. Your gallery will be available for you to download for up to 2 months from the date the email was sent. So we would recommend downloading your gallery and saving files in multiple places for safe keeping.

After your gallery expires, If you would like us to reactivate your gallery or resend you an additional USB this will incur a £75 reactivation/additional USB fee, which the client will have to pay for the fee upfront via bank transfer.

The complete wedding gallery or individual wedding photographs shall be retained in our system for a period of two years. PKay Bridal provides USB sticks (which have been purchased or includes in our photography package) in fully operational condition. However, given the inherent nature of technology, we cannot be held liable or provide any warranty for potential technological failures occurring after the physical product has been delivered. We have created an aftercare advice page outlining various backup recommendations. Upon delivery of the gallery, the client acknowledges and agrees that it is their responsibility to promptly download and backup their wedding gallery.

Sharing, Watermarking and Editing

These are your images, we hope you love them as much as we do and cannot wait to share it with your Friends, families and loved ones. All we ask is for some type of credit when you use our images on social media. We always encourage our clients not to re-edit their images e.g. filter etc. When it comes to watermarking - for photoshoot and mini photo session where the number of images are limited depending on package purchases, watermarking will be visible when you view your gallery, but don't worry once you select your favourite images into your cart, your purchased Hi-resolution downloads will be watermark free. As for weddings - watermarking only applies on web and social media sharing size images but your Hi-resolution downloads are watermark free.

Can my wedding suppliers use your images?

Of course they can, for third party usage whether they are your florist, makeup artist or venue, I'm completely happy for them to do so as it's take team to make wedding. They are allowed to share your wedding images. If you have already provide me with their IG link in your wedding details questionnaire, I be in touch with them and will send them a link to your Highlight gallery/ sneak peek gallery.

****Please let your suppliers know that, if they would like some images from your gallery to either publish on their social media/ website/ marketing etc. They will have to contact me (Photographer) directly, that way I can add your suppliers to your gallery link. They will received better quality images and most importantly I can tell them not to screenshot or put filer on top of this master piece.***

Limitation of liability

PKay Bridal recommended that you take out wedding insurance. PKay Bridal shall have no liability for any third party (product or service) whatsoever, regardless of cause, even if it has been recommended by us. In the case of unsatisfactory outcome of your wedding photography, PKay Bridal will not be liable to any client unsatisfactory compensation. We will not be liable to give our client any refund due to unsatisfactory outcome for the work we have already carried out.

Acceptance

I am 18 years of age,or older, and I am competent to contract in my own name. I have read this release before signing and agree to hire PKay Bridal as my photographer, and I fully understand the contents, meaning and impact of this release. I understand that I am free to address any specific questions regarding this release by submitting those questions in writing prior to signing, and I agree that my failure to do so will be interpreted as a free and knowledgeable acceptance of the terms of this release.

By using any images and hiring PKay Bridal you agree to the above terms.

By transferring your deposits/booking and reservation fee to secure your dates and making your final payment, you are acknowledge and accepting these terms and conditions.
